TERMS OF SALE

These terms apply to all orders placed through mmspecialtyservices.com or with M&M Specialty Services, LLC ("M&M"). Placing an order means you accept these terms.

 

1. Orders and Acceptance

An order is a request to purchase. M&M may accept, decline, or cancel any order, including for pricing errors, product availability, or failure to meet the eligibility requirements below. Prices shown on the site do not include applicable tax or shipping unless stated. Items marked "Request a Quote" are priced on request.

 

2. Payment

All orders are invoiced. After you place an order, you will receive an invoice with a secure payment link. Invoices are due on receipt. Orders are not processed, fulfilled, or shipped until payment is received in full.

 

3. Restricted-Use Pesticides and Fumigants

Restricted Use Pesticides (RUPs), including grain fumigants, are sold only to certified applicators, or to persons under their direct supervision, as required by federal and state law.

  • Before an RUP order ships, the buyer must provide a current, valid applicator certification number and issuing state, [and a copy of the license].

  • M&M will verify certification before fulfillment. Orders that cannot be verified will be canceled and refunded.

  • The buyer is responsible for using, storing, and disposing of all products according to the label and all applicable laws. The label is the law.

  • [RUPs may be unavailable for shipment to certain states.]

 

4. Hazardous Materials Shipping

Some products, including fumigants and calibration gas cylinders, are regulated as hazardous materials.

  • These items ship by ground only, using approved carriers and packaging, and may carry separate shipping charges or timelines.

  • Hazardous materials cannot ship to P.O. boxes [or to certain states or territories].

  • The buyer must be able to legally receive the product at the delivery address.

  • Some hazmat orders require the buyer to acknowledge the shipping terms at checkout.

 

5. Shipping and Delivery

Ship dates are estimates. Risk of loss passes to the buyer when the order is delivered to the carrier. Inspect all shipments on arrival and report damage or shortages within 5 business days, as described in the Return Policy.

 

6. Returns

Returns are governed by the Return Policy. Restricted-use pesticides, fumigants, and opened calibration gas cylinders cannot be returned.

 

7. Warranties

Products carry only the manufacturer's warranty, where one applies. M&M is a distributor and makes no additional warranties, express or implied, including merchantability or fitness for a particular purpose, except where the law does not allow this disclaimer.

 

8. Limitation of Liability

To the fullest extent permitted by law, M&M's total liability for any claim related to a product or order is limited to the purchase price of that product. M&M is not liable for indirect, incidental, or consequential damages, including lost grain, product, or business.

 

9. Safety Equipment

Gas detection, respiratory, and fall protection equipment must be selected, fitted, inspected, calibrated, and used by trained personnel according to the manufacturer's instructions and applicable OSHA requirements. The buyer is responsible for proper selection and use.

 

10. Governing Law

These terms are governed by the laws of the State of Kansas. Any dispute will be resolved in the state or federal courts serving Leavenworth County, Kansas.

 

11. Changes

M&M may update these terms at any time. The terms in effect when you place an order apply to that order.
